The Four Most Important Essays

Federalist No. 10 (Madison) — Factions

The central problem of republican government is "factions" — groups that pursue their interest at the expense of others. A large republic is better at controlling factions than a small democracy: in a large republic, no single faction can dominate; they must form coalitions that moderate their demands. The diversity of interests in a large republic is a strength, not a weakness.

Federalist No. 51 (Madison) — Checks and Balances

"If men were angels, no government would be necessary." Since they are not, government must check itself. Each branch must have the means and motivation to resist encroachments by the others — "Ambition must be made to counteract ambition." Separation of powers + checks and balances = the solution to government tyranny.

Federalist No. 78 (Hamilton) — The Judiciary

The judiciary is the "least dangerous branch" — it has neither force (executive) nor will (legislative), only judgment. Hamilton provides the logical foundation for judicial review: the Constitution is supreme; courts must interpret the law; therefore courts must have the power to invalidate laws that violate the Constitution.

Federalist No. 84 (Hamilton) — Against a Bill of Rights

Ironically, Hamilton argued a Bill of Rights was unnecessary — even dangerous, as enumerating rights might imply that unlisted rights don't exist. He was wrong; the 9th Amendment was added precisely to prevent this inference.

Why They Still Matter

The Federalist Papers are cited in over 2,000 Supreme Court and federal court decisions as authoritative interpretations of the Constitution's meaning and the framers' intent. They are the primary source for "originalist" constitutional interpretation.
